"Display the same navigation items as the parent site" greyed out

I've started with a new client who has SP 2010 running. 

Question #1: on sub sites, the option "Display the same navigation items as the parent site" is greyed out. Why would that be?  The "SharePoint Server Publishing Infrastructure" is active.

Question #2: If I can't get that to work, I wanted to add at least the top level site to Global Navigation and can do that, but it's the last link, not the first one.  The "Move Up" button is greyed out because this manually added link is the only one in that section.  For example, if the subsite is "Accounting" and the top level is "InnerSpace", the menus should be InnerSpace, then Accounting, but it's the other way around.
